How many SaaS terms of service forbid AI agents?
Few do. 7 of the 132 products whose terms we read (5%) forbid accounts made by an AI agent.

What to write in your terms
- Say that an agent may hold an account for the person or company it acts for.
- Put the limit on bulk or abusive sign-ups, not on automation as such.
- Say who is responsible for what the agent does: the person or company it acts for.
- Link the terms from the sign-up page, next to the button.
For agent builders
- Read the terms before your agent signs up.
- Look for two phrases: a person must make the account, and accounts made by automated means.
- Act for a named person or company, so the account is theirs.
- Where the terms forbid it, have the person make the account and give your agent a key.
What we found.
Where the terms forbid it, the product's page quotes the clause word for word, with the day we read it.
| Terms | Of 132 | What it means |
|---|---|---|
| Forbid agent accounts | 7 (5%) | A person must make the account, or automated sign-up isn't allowed. |
| No such clause | 125 (95%) | Nothing in the terms stops an agent making the account. |
Method and limits.
How we tested
- Terms read from 17 Oct to 1 Nov 2026, at 132 of the 201 products in the directory.
- Before our agent agrees to a product's terms, we fetch the terms and acceptable use policy its home and sign-up pages link to.
- A clause counts only when it is explicit: a person must make the account, or accounts made by automated means are forbidden.
- A clause about bulk accounts, scraping or heavy traffic doesn't count.
Limits
- Each product's terms as they read on the day we read them.
- Products whose terms we haven't read yet are left out of the count.

Corrected 1 Nov 2026. Our earlier count included clauses about cancelling an account, repaying a loan and who answers for an agent's actions. None forbids agent accounts, so they no longer count.
